Hello all,
I understand this has already been discussed and it has been agreed that "embargos de declaração" are "motions for clarification" and it makes perfect sense regarding the document I'm working on. But who/what is an "embargante" and "embargado" in English? The original document is Brazilian. And then we have the "acordão embargado", which I suppose is the "decision under analysis", but is this correct or is there a proper term?

motion for clarification
"Embargante" is the party who files the motion, "embargado" is the other party. It's not an appeal, since it will not be answered by another court, but by the same judge(s) who issued the "decisão embargada" (decision that needs to be clarified), either a "sentença" (single-judge decision) or an "acórdão" (a decision by a collegiate court).
