This Direct Payment Agreement (“the Agreement”) sets out the steps that you need to take when you receive your direct payment. This agreement is between the person receiving the Direct Payment (you) and [Kensington and Chelsea Council OR Westminster City Council] (we/us). You have responsibility for the above child and through this agreement you are willing and able to secure the services required to meet his or her assessed needs. Please read it carefully as it is legally binding.
1. Basis of Agreement
1.1 We have carried out an assessment of your child’s eligible needs and have agreed to the social care support described in your child’s current Care and Support Plan (enclosed) to be provided through a Direct Payment.
1.2 We will provide your child’s Direct Payment via a Pre-paid Card which the Direct Payments/Personal Budget Lead will arrange for you, and it is owned by us.
1.3 This account may only be used for Direct Payments/Personal Budget-related expenditure as agreed in your child’s Care Plan to enable you to buy the support you have been assessed as needing.
1.3 You will be responsible for paying for the support your child receives, including all agency invoices and employee wages/salaries.

Este Contrato de Pagamento Direto (“o Contrato”) estabelece os passos que precisa seguir ao receber o seu pagamento direto. Este contrato é celebrado entre a pessoa que recebe o Pagamento Direto (“o(a) senhor(a)”) e o [Kensington and Chelsea Council OU Westminster City Council] (nós). É responsável pela criança acima mencionada e, por meio deste contrato, está disposto e apto a garantir os serviços necessários para atender às necessidades avaliadas da mesma. Leia-o cuidadosamente, pois é juridicamente vinculativo.
1. Fundamento do Contrato
1.1 Realizámos uma avaliação das necessidades elegíveis da sua criança e concordámos com o apoio social descrito no Plano de Cuidados e Apoio atual da sua criança (em anexo), a ser prestado através de um Pagamento Direto.
1.2 Forneceremos o pagamento direto da sua criança através de um cartão pré-pago que o responsável pelos pagamentos diretos/orçamento pessoal providenciará para si e que é da nossa propriedade.
1.3 Esta conta só pode ser utilizada para pagamentos diretos/despesas relacionadas com o orçamento pessoal, conforme acordado no Plano de Cuidados da sua criança, para que possa adquirir o apoio que foi avaliado como necessário.
1.3 Será responsável pelo pagamento do apoio que a sua criança recebe, incluindo todas as faturas da agência e os salários dos funcionários.

Veio o Ministério Público instaurar procedimento urgente, que designou de “Providência Cautelar para entrega de criança com vista ao regresso ao Reino Unido”, nos termos das disposições conjugadas nos artigos 3°, al. d), 6°, al. d), 17°, 45° e ss., do Regime Geral do Processo Tutelar Cível, artigo 1887.° do Código Civil, artigos 4.°, n.º 1, als. b) and r) do Estatuto do Ministério Público e artigos 1.º, 2.º, 3.º., 4.º, 6.º, 7.º, als. a), b), c) e f), 11.º, 12.º e 14.º, todos da Convenção sobre os Aspectos Civis do Rapto Internacional de Crianças, subscrita por Portugal e pelo Reino Unido em 25 de Outubro de 1980, e aprovada por Portugal através do Decreto do Governo n.º 33/83 de 11 de Maio.
Os presentes autos foram recebidos como procedimento cautelar e prosseguiram a sua ulterior tramitação como tal, com a tomada de declarações à progenitora, bem como se determinando a citação do requerido e sua notificação para prestação de esclarecimentos, desta feita por escrito.
Nessa decorrência, por despacho de 14.09.2024, com a referência 100208821, entendeu este tribunal que teve lugar o início da diligência de produção das provas que irão sustentar a decisão final, no sentido de determinar ou não o regresso da criança ao Reino Unido, com a inerente procedência ou improcedência deste procedimento.
Mais se constatou que a Ex.mª Magistrada Judicial que vem presidindo às diligências de prova em curso nos presentes autos já não exerce actualmente funções neste Juíz I, do Juízo de Família de Menores de Setúbal, em consequência do último movimento judicial oridinário.
Tendo presente o teor das disposições ínsitas no n.º 3 e no n.º 4, do art.º 605, do Código de Processo Civil, as quais (entre outras) materializam o princípio da plenitude de assistência do juíz, estabelecem as mesmas que, quando o juíz for transferido, como sucede in casu, concluirá o julgamento e elaborará a sentença.

The Public Prosecutor's Office initiated urgent proceedings, which it named ‘Preliminary Injunction for the Surrender of a Child with a View to Return to the United Kingdom’, under the terms of the combined provisions of Articles 3(d), 6(d), 17, 45 et seq. [and the following ones] of the Regime Geral do Processo Tutelar Cível [General Civil Procedure Rules - Guardianship Proceedings], Article 1887 of the Código Civil [Civil Code], Articles 4(1)(b) and (r) of the Estatuto do Ministério Público [Statute of the Public Prosecutor's Office] and Articles 1, 2, 3, 4, 6, 7(b), (c) and (f), 11, 12 and 14, all of the Convention on the Civil Aspects of International Child Abduction, signed by Portugal and the United Kingdom on 25 October 1980, and approved by Portugal through Government Decree no. 33/83 of 11 May.
These proceedings were received as a precautionary procedure and processed as such, with statements being taken from the parent, as well as the defendant being summoned and notified to provide clarifications, this time in writing.
As a result, pursuant to the order of 14/09/2024, with the reference 100208821, this court understood that the diligence to produce the evidence - that will support the final decision, to determine whether or not to return the child to the United Kingdom, with the inherent acceptance or rejection of this procedure, had begun.
It was also observed that the former Honourable Magistrate that has been presiding over the acts of production of evidence, underway in these proceedings, no longer serves in this Court I, of the Setúbal Family and Minors Court, as a result of the last round of routine judicial appointments.
Considering the provisions of Article 605(3) and (4) of the Code of Civil Procedure of Portugal, which (among others) enshrine the principle of the judge's full assistance, it is established that, when the judge is transferred, as it happens in this case, he will conclude the trial and draw up the judgement.

Bio
I am a Portuguese award-winning, published writer and translator living and working in London. Having studiied Media Studies in Portugal, BA, I went on to study literary adapation in France [La Poudriere], where I specialized in cinema, animation film and scriptwriting. In 2011, I finished an MA in Writing for Perofrmance, with merit award, from Goldsmiths College, London. More recently, in 2025, I finished the DIP Trans 7, CIOL, with distinction for law and literature. My plays, books and short stories were published in Portugal, France, Switzerland and Brazil. My plays were translated into Bosnian, English, French, Korean, Spanish, German, Polish and Chinese. I was a recipient of numerous awards, namely calouste Gulbenkian Foundation, Lisbon, 2010/11, Act-Arriaga Prize, Act Festival, 2011, Bilbao, Co-winner -This is not a competition, Artistas Unidos, Lisbon, Portugal, 2008. Currently, I translate for the Ministry of Justice UK, as well as to some publishing houses and agencies in Portugal and the UK. In the past, I have translated also for the National Theatre UK.
