Hi All,

I am currently translating an insurance policy and would appreciate any advice/suggestions for the above term. I have seen various other entries for the term, but was not sure whether they would apply in this context.

The definition given is that the "prescrição" is that it is the means by which rights are acquired and obligations are extinguished over time.

It is the period defined by law during which a right can be exercised. Once the period is over, the right no longer exists. The law that determines this period for a given situation is often called a "statute of limitations".

My suggestion above is taken from Maria Chaves de Mello's "Dicionário Jurídico". It is the name of the phenomenon itself, which is enacted through a "statute of limitations" in some legal systems.

According to Wikipedia:
"In civil law systems, similar provisions are typically part of the civil code or criminal code and are often known collectively as periods of prescription."

O termo "statute of limitations" se refere à lei mas popularizou-se e é usado corriqueiramente nos EUA para expressar "o perído de prescrição", ou seja, o período de tempo em que se pode dar entrada em um processo após um delito é cometido.
