"In previous practice, if an application received what is referred to as a "final rejection" from the Patent Office, the applicant could file a continuation, called a "file wrapper continuation," in which the prosecution of the application was abandoned and transferred to a new application for continuation of the prosecution. This required the application to be removed from the Examiner, to be assigned a new serial number, and to be put back into the queue for examination. These procedural steps resulted in a significant delay in prosecution. This delay became a serious problem when the United States amended its laws so that a patent term is now measured from the date of filing of the application for a patent, rather than from the date of issuance of the patent itself."

CONTINUATION:
Ab 1. November 2007 gelten neue Regeln für die Anmeldung von Patenten in den USA. Danach können zukünftig maximal zwei Folgeanmeldungen - sogenannt ‚continuation‘, ‚divisional‘ und ‚continuation in part‘ Anmeldungen – eingereicht werden. Bislang gab es für Folgeanmeldungen keine Begrenzung.

Was kann im Fall einer Zurückweisung unternommen werden?
Soll die Anmeldung gegen eine abschliessende Zurückweisung («final») weiter verteidigt werden, kann man entweder in die Beschwerde gehen oder eine Fortsetzungsanmeldung bzw. einen Antrag auf Fortsetzung der Prüfung stellen. Für die Fortsetzung ist eine weitere Prüfungsgebühr zu entrichten

File Wrapper Continuation - obsolete - a way of continuing prosecution in an application under final rejection. The old file was literally wrapped in a new paper wrapper, and continued onward. This procedure was replaced by the CPA, which, in turn, was replaced by the RCE. See also continuation.

Die Fortsetzungsanmeldung setzt eine frühere Anmeldung fort, lässt diese aber fallen. Die Fortsetzungsanmeldung darf keinen neuen Inhalt enthalten.
Sie wird benutzt, wenn der Prüfer im Erteilungsverfahren die Ansprüche bereits gewährt hat, die damit unverändert bleiben müssen. Will man die Ansprüche trotzdem ändern, setzt eine Fortsetzungsanmeldung das Erteilungsverfahren wieder in Gang.
