Full sentence:
By consent, upon the earlier of the payment of the sums set out in paragraph 6 herein or the date upon which a request is made by the Respondent, the Claimant will release the Certificates of Pending Litigation registered against the real properties set out in paragraph 2 herein.
I am considering translating the "against" generically with something along the lines of "riguardo a", but there should be a more correct legal phrase.

Bear in mind that the certificate is registered against the real property. The effect of a registered certificate of pending litigation is that, after registration of a certificate of pending litigation, the registrar must not make any entry in the register that has the effect of charging, transferring or otherwise affecting the land described in the certificate until registration of the certificate is cancelled in accordance with the Land Titles Act.
