DIVORCE DECREE
CASH SETTLEMENT
XXX shall pay to YYY the sum of R XXXX in full and final settlement of all claims that YYY may have arising out of the marriage.
Payment of the settlement referred to in paragraph 11.1 shall be made in full on or before XXXX 2013.
Should XXX fail to pay the amount specified in paragraph 11.1 above on the due date, she shall be liable for payment of interest at the prime rate charged by First National Bank from time to time, calculated on the outstanding balance from the date that the payment was due until the date that payment of the capital and accrued interest (if any) has been made in full.
The CASH SETTLEMENT is an item of the overall Settlement Agreement.
First item related to the immovable properties previously jointly owned by the spouses
Second item referred to the movable property
this item is the cash settlement
and the following one is "other assets"
I have translated the Settlement Agreement as "état liquidatif"
I don't think this item should be translated as Règlement en espèces, because it is a settlement in the same order of ideas as the Settlement Agreement. As is also shown by the term "payment of settlement". and to say "paiement du règlement"would not make sense at all.
Please could those of you who are very knowledgeable in this area, give me a carefully thought out suggested translation, and maybe some French links confirming the use of their suggestion.

règlement en espèces, paiement du montant convenu
See the discussion above for an explanation. This is simple: "cash settlement" refers to the type of settlement (one in which the parties have agreed that party A will pay money to party B), and the word "settlement" in "payment of settlement" actually means "settlement amount" (the quantity of money on which the parties have agreed).

J’appuie les deux propositions.
So in your document, "cash settlement" describes the type of settlement (thus, paiement en espèces) and "payment of settlement" means payment of the agreed amount ("paiement du montant convenu," or words to that effect).
Not sure why you are complicating things? This is actually pretty straightforward.
a proposal for settlement of the pecuniary and patrimonial interests of the spouses.

If the draft of the liquidation of the matrimonial regime drawn up by the notaire appointed under Article 255, 10°, contains sufficient information, the judge, upon request of either spouse, shall rule on the enduring disagreements between them.
a draft settlement of the effects of divorce.

1- I have translated the English Term "Settlement Agreement" as état liquidatif (this is in the context of a divorce).
2- as to the cash settlement does indeed describe the payment of actual money by X to Y
As for cash settlement, could you clarify what the settlement agreement says will be done? Is any cash (or equivalent, e.g. bank accounts) being conveyed from party X to party Y? Are non-liquid assets, such as real estate or personal property, being transferred?
It sounds like all of that is happening, and the part of the settlement agreement that refers to "cash settlement" is describing the payment of actual money by X to Y. Is that the case?
