Source text - Indonesian SEJARAH DEPARTEMEN KEHAKIMAN
Departemen Kehakiman RI ditetapkan sebagai Kementerian Negara dalam sidang Panitia Persiapan Kemerdekaan Indonesia pada tanggal 19 Agustus 1945, dua hari setelah proklamasi Kemerdekaan RI. Prof. Dr. Soepomo yang diangkat menjadi Menteri pertama dinobatkan sebagai Bapak Pendiri Departemen Kehakiman.
Pada awalnya Departemen Kehakiman RI bertugas menyelenggarakan urusan administrasi peradilan umum dan Kejaksaan. Namun dalam perkembangan Kejaksaan menjadi Institusi yang berdiri sendiri sejak Juli 1960. Sedangkan urusan peradilan umum tetap merupakan tugas Departemen Kehakiman.
Pada awal orde reformasi berdasarkan Keputusan Presiden RI Nomor 136 Tahun 1999 terjadi perubahan penamaan dari Departemen Kehakiman RI menjadi Departemen Hukum dan Perudangan-Undangan RI. Selanjutnya dengan adanya perkembangan dan perubahan luasnya ruang lingkup tugas, berdasarkan Keputusan Presiden RI Nomor 165 Tahun 2000 Departemen Hukum dan Perundangan-Undangan RI diubah menjadi Departemen Kehakiman dan Hak Asasi Manusia RI.

Memantapkan sistem hukum nasional dalam rangka menegakkan supremasi hukum dan hak asasi manusia.

KEDUDUKAN, TUGAS, FUNGSI DAN KEWENANGAN DEPARTEMEN KEHAKIMAN DAN HAK ASASI MANUSIA RI
KEDUDUKAN
2. Departmen Kehakiman dan Hak Asasi Manusia dalam Pemerintah Republik Indonesia yang selanjutnya dalam Keputusan Presiden ini disebut Departemen, merupakan salah satu salah unsur pelaksana Pemerintah.
3. Departemen dipimpin oleh Menteri Kehakiman dan Hak Asasi Manusia yang berada dibawah dan bertanggung jawab kepada Presiden.
TUGAS
Departemen Kehakiman dan Hak Asasi Manusia mempunyai tugas membantu Presiden dalam menyelenggarakan sebagian tugas pemerintah di bidang Kehakiman dan Hak Asasi Manusia.
FUNGSI
Dalam melaksanakan tugas tersebut Departemen Kehakiman dan Hak Asasi Manusia menyelenggarakan fungsi:
a. Pelaksanaan urusan pemerintah di bidang hukum dan hak asasi manusia.
b. Pembinaan dan koordinasi pelaksanaan tugas serta pelayanan administrasi Departmen.
c. Pelaksanaan penelitian dan pengembangan terapan, pendidikan dan pelatihan tertentu serta penyusunan peraturan perundang-undangan yang menjadi kewenangannya sesuai dengan ketentuan peraturan perundang-undangan yang berlaku dalam rangka mendukung kebijakan di bidang hukum dan hak asasi manusia.
d. Pelaksanaan pengawasan fungsional.
KEWENANGAN
Dalam melaksanakan fungsi tersebut Departemen Kehakiman dan Hak Asasi Manusia menyelenggarakan kewenangan :
a. Penetapan kebijakan di bidangnya untuk mendukung pembangunan secara makro.
b. Penyusunan rencana nasional secara makro di bidangnya.
c. Pelaksanaan penelitian dan pengembangan terapan, pendidikan dan pelatihan tertentu serta penyusunan peraturan perundang-undangan yang menjadi kewenangannya sesuai dengan ketentuan peraturan perundang-undangan yang berlaku dalam rangka mendukung kebijakan di bidang hukum dan hak asasi manusia.
d. Pelaksanaan pengawasan fungsional
e. Penetapan kebijakan sistem informasi nasional bidangnya.
f. Pembinaan Hukum dan peraturan perundang-undangan nasional.
g. Pengesahan dan persetujuan badan hukum di bidangnya.
h. Pengesahan di bidang hak Atas kekayaan Intelektual.
i. Kewenangan lain yang melekat dan telah dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku, seperti:
2. Pengaturan dan Pembinaan terhadap bidang pemasyarakatan, kemigrasian dan kenotariatan.
3. Pengaturan dan Pembinaan terhadap bidang ketahanan, benda sitaan negara dan barang rampasan negara, peradilan dan penasehat hukum, pendaftaran jaminan fidusia, perubahan nama, harta peninggalan, kepailitan, ketatanegaraan dalam bidangnya dan kewarganegaraan.
4. Peraturan dan pembinaan di bidang dagtiloskopi, grasi, amnesti, abolisi, rehabilitasi dan penyidik pegawai negeri sipil.

The Department of Justice of the Republic of Indonesia has been stipulated as the State Minister in the session of the Indonesia Independence Preparation Committee on August 19th, 1945, two days after the proclamation of the Independence of the Republic of Indonesia Professor Dr. Soepomo, who was appointed to be the first Minister was installed as the Founding Father of the Department of Justice.
Initially the Department of Justice of the Republic of Indonesia had a task to hold the administration of the general judicature and the Office of the Prosecutors. But in its development the Office of the Attorney turned into an Institution that has been established since July 1960. Whereas the administration of the general judicature is the task of the Department of Justice.
In the early reformation order, based on the Presidential Decree of the Republic of Indonesia No. 136 of 1999 there has been a name change, from the Department of Justice of the Republic of Indonesia to the Department of Law and Legislation of the Republic of Indonesia. Then with the development and a change of the size of the task scope, based on the Presidential Decree of the Republic of Indonesia No. 165 of 2000 the Department of Law of Legislation of the Republic of Indonesia was changed into the Department of Law and Human Rights of the Republic of Indonesia.

POSITION
1. The Department of Justice and Human Rights in the Government of the Republic of Indonesia, which hereinafter in this Presidential Decree is called the Department, which is one of the elements of the Government’s implementers.
