Italian term (edited):
Sul fumus boni iuris
Selected
Prima facie case

Note from asker:
I tend to agree, but the thing holding me back is that the heading is shortened to only "Sul fumus". The content of the section is the defence's dissertation on how the plaintiff's motives for appeal are groundless if that helps narrow things down... In tanto - Grazie! |

: I do agree, it is usual to shorten it to only "Sul Fumus": for an Italian Lawyer there is only one "Fumus" the "Fumus Boni Juris". Which is the superficial good founding of the case. It is one of the two requirements of an interlocutory proceeding

Note from asker:
Anch'io avevo visto quello... infatti, è l'unico riferimento a "fumus" che sono riuscito a trovare, ma non mi sono convinto al 100%, per questo ho posto la domanda... Grazie! :) |

: It can't mean anything else, especially if it's a section heading in a brief.
