I translate erfinderischer Tatigkeit as inventive step, but I cannot see how you can have an excess / surplus inventive step - either something is one or isn't.
What am I missing here?

further inventive step
You are correct that the term of art for 'erfinderischer Tätigkeit' is 'inventive step.'
In this context 'Überschuss' simply means 'additional' or 'further'.
So I would suggest 'further inventive step' or 'additional inventive step.' The sense of 'excess' or 'surplus' in English would not be correct.

step that exceeds prior inventive activity
"...does not constitute a step that exceeds (goes beyond) prior inventive activity.."
That's my reading of it. I think the meaning is clear. Question is whether the language can be improved upon.

an additional inventive contribution
"A technical teaching which relates to the application of a discovery in order to achieve a technical effect represents patentable subject-matter both according to European and German law. This principle applies independent of whether there is "an additional inventive contribution" ("erfinderischer Überschuss")<b/>, in addition to the discovered relationship according to the law of natures."
