Anspruch 4 ist ein Kombination von verschiedenen Losungsmitteln in den Verfahrensschritten 1 und 3. Unseres Erachtens lasst das, was Gegenstand des Anspruchs 4 ist, keinen *Uberschuss* an erfinderischer Tatigkeit gegenuber A1, A3 oder A6 zu.

Das, was Gegenstand der Anspruche 7 bis 9 und 10 ist, lasst unseres Erachtens keinen *Uberschuss an erfinderischer Tatigkeit* erkennen, sondern lediglich eine fur den Fachmann naheliegende und daher nicht patentfahige Ausgestaltung eines Extraktions-Verfahrens, wie in den Anlagen A1 bis A6 offenbart.

I translate erfinderischer Tatigkeit as inventive step, but I cannot see how you can have an excess / surplus inventive step - either something is one or isn't.

What am I missing here?

Überschuss I don't 100% understand the context, but I think the point is to do with the fact that you can't patent X unless it involves extra inventiveness by comparison with Y. In this case that extra inventiveness is not present because the issue is "für den fachmann naheliegend" and hence "nicht patentfähig".

You are correct that the term of art for 'erfinderischer Tätigkeit' is 'inventive step.'
In this context 'Überschuss' simply means 'additional' or 'further'.
So I would suggest 'further inventive step' or 'additional inventive step.' The sense of 'excess' or 'surplus' in English would not be correct.

"...does not constitute a step that exceeds (goes beyond) prior inventive activity.."

That's my reading of it. I think the meaning is clear. Question is whether the language can be improved upon.
