Subject to the return of invested capital and the Preferred Return, the Founder Partner will be entitled to carried interest equal to 10% of the Partnership’s profits, with a catch-up provision upon achieving the Preferred Return.
Meine bisherige Lösung, bei der ich nicht sicher bin, ob das so stimmt:
Der Gründungspartner hat abhängig vom ROIC und der Hurdle Rate Anspruch auf einen Gewinnanteil im Wert von 10 % der Gewinne des Dachfonds, mit Catch-up bei Erreichen der Hurdle Rate.
Anm.: Der Kunde übersetzt "Partnership" mit "Dachfonds" und "Preferred Return" mit "Hurdle Rate".
Was meint ihr zu meiner Lösung? Vielen Dank für eure Hilfe!

Ich verstehe es so, dass die Provision bis zum erreichen der Hurdle Rate nicht oder nicht in voller Höhe anfällt, aber dann nachgeholt wird

These types of performance allocation arrangements usually include both "catch up" provisions that pay the fund's managers a larger percentage of profits after the investors have received their return of invested capital (on sold deals, if applicable) and also hurdles, so that the manager recoups its 20% share of the hurdle.
