to act in one's official capacity = kraft seines Amtes handeln, in amtlicher Eigenschaft handeln.
Da es hier um eine anwaltliche Vollmacht geht, denke ich, dass hier an einen Stellvertreter (mit Vollmacht) gedacht ist.
