Interesting question. 1 would be "the appeal was summarily dismissed", while 2 would be "the appeal was dismissed on the merits".

To Mark Mark, I understand your point here, and I want to take this chance and ask you if in English we have a way to tell the difference between 'não conhecer um recurso', in which the court finds that the appeal should not even be perused and 'negar provimento ao recurso', in which the appeal is perused, but denied, like it happens in Brazil
