DECRETA
Título Único De las criptomonedas o monedas virtuales
Capítulo I Del uso de las criptomonedas o monedas virtuales en Colombia
Artículo 1°. Objeto. La presente Ley tiene por objeto regular las transacciones y operaciones civiles y comerciales de las criptomonedas o monedas virtuales, entre personas de derecho privado y público, para la adquisición de bienes y servicios, en todo el territorio colombiano; así como las disposiciones de protección, vigilancia, inspección y control sobre dichas operaciones.
Artículo 2°. Principios. Las operaciones con criptomonedas o monedas virtuales estarán basadas en los principios de inclusión e innovación en las formas de transacción que se han desarrollado con los nuevos avances tecnológicos, la promoción de la competencia privada, el mejoramiento en las formas de protección al consumidor y la prevención de fraudes.
Artículo 3°. Definiciones. Para efectos de la presente Ley, se entenderán como definiciones que permita la interpretación de la misma, los siguientes:
3.1 Criptomonedas o monedas virtuales. Es un activo de carácter virtual, el cual se representa en un valor que se registra de forma electrónica y que puede ser utilizado por las personas como forma de pago para cualquier tipo de acto jurídico y cuya transferencia únicamente puede llevarse a cabo a través de medios electrónicos.
3.2 Blockchain. Base de datos distribuida y conformada por cadenas en bloques, la cual está diseñada para evitar su modificación, después de realizar la publicación de un dato usando un sellado de tiempo confiable, el cual es enlazado a uno de los bloques de la cadena.
3.3 Wallet o billetera virtual. Sistema de almacenamiento virtual de diferentes criptomonedas o monedas virtuales, el cual es utilizado como forma de transacción para el pago mediante este tipo de monedas.
3.4 Trading. Es la actividad mediante la cual se realiza la compra y venta de monedas virtuales en las diferentes plataformas de transacción.
3.5 Traders. Son aquellas personas naturales que por su conocimiento y experiencia realizan las labores de trading, ya sea por mutuo propio o por encargo mediante contrato de administración de criptomonedas.
3.6 Adquirente. Es la persona natural o jurídica que, con previo consentimiento informado, adquiere criptomonedas o monedas virtuales, con el fin de operar con éstas, ya sea para adquirir o intercambiar bienes o servicios, o para realizar trading.
Artículo 4°. Entidades de operaciones con criptomonedas. Son aquellas personas jurídicas con ánimo de lucro o naturales que ejerzan como comerciantes y con establecimientos de comercio inscritos en la Cámara de Comercio, cuyo objeto social sea la comercialización, administración o trading de criptomonedas, con previa autorización emitida por el Ministerio de Tecnologías de la Información y de las Comunicaciones.
Estas entidades también podrán realizar actividades de administración de monedas virtuales, trading y operaciones de comercialización, según el mandato extendido por escrito entre la entidad y el adquirente, donde se deje de forma expresa las obligaciones de cada una de las partes, los riesgos que asumen cada una de ellas, y la necesidad de cubrir los riesgos mediante garantías.
Las entidades de operaciones con criptomonedas, deberán estar en posibilidad de entregar al adquirente, cuando lo solicite, la cantidad de monedas virtuales de que éste sea titular, o bien el monto en moneda nacional correspondiente al pago recibido de la enajenación de los mismos.
Estas entidades o establecimientos de comercio deberán tener el Sistema de Administración de Riesgo de Lavado de Activos y Financiación del Terrorismo (SARLAFT), aprobado por la Unidad de Información y Análisis Financiero (UIAF), quien podrá generar recomendaciones para efectos de su aprobación.
Parágrafo primero. Las entidades de operaciones con criptomonedas tendrán prohibido vender, ceder o transferir su propiedad, dar en préstamo o garantía o afectar el uso, goce o disfrute de las monedas virtuales que administren de los adquirentes que se las hayan dejado en custodia, excepto cuando haya expresa facultad de disposición por parte de éste.
Parágrafo segundo. Deber de informe. Por medios escritos o virtuales, las entidades o establecimientos de comercio de que trata este artículo, deberán publicar las características técnicas de la comercialización con criptomonedas y los riesgos que corren las personas que adquieren este tipo de moneda.
Parágrafo tercero. Las sociedades comerciales o los establecimientos de comercio de que trata el presente artículo, deberán informar a la Fiscalía General de la Nación, cualquier movimiento anómalo que detecten en sus transacciones, y que puedan tener connotaciones de lavado de activos, financiación del terrorismo, y los demás delitos conexos a éstos, so pena de ser sancionados con la disolución y liquidación de la sociedad, cancelación de la matrícula de comercio y los demás efectos legales contemplados.
El Ministerio de Tecnologías de la Información y de las Comunicaciones, deberá regular dentro de los seis (6) meses siguientes a la obligación de la presente la ley, los requisitos que las sociedades comerciales o los establecimientos de comercio deben reunir para obtener la autorización de comercialización con criptomonedas en Colombia.
Artículo 5°. Consentimiento informado. Es el deber que tienen las entidades de operaciones con criptomonedas, para con el adquirente, de informar las especificaciones de la comercialización con monedas virtuales, las formas en que pueden adquirir las criptomonedas y toda información que sea necesaria para el cabal entendimiento del uso de las monedas virtuales.
Así mismo, se deberá informar lo siguiente:
a. Las criptomonedas no son monedas de curso legal utilizadas por el Estado colombiano, y por tal razón no tienen respaldo del Gobierno Nacional, ni del Banco de la República.
b. Las operaciones realizadas no son reversibles después de ejecutadas.
c. Las monedas virtuales y el mercado donde éstas operan, son volátiles, y su control está sometido a las reglas propias de ese mercado.
d. Existen riesgos tecnológicos, cibernéticos y de fraude inherentes a las operaciones con criptomonedas.
Este consentimiento informado deberá estar siendo actualizado, según aparezcan nuevos riesgos para las transacciones con criptomonedas.
Artículo 6°. Operaciones o transacciones con monedas virtuales. Son aquellas mediante las cuales, las partes manifiestan su voluntad libre e informada de realizar transacciones con monedas virtuales, que permiten la creación de actos jurídicos que los vinculan entre sí, siempre que éstos se reputen únicamente sobre actividades lícitas y legales.
Las partes están en la libertad de establecer las condiciones de cumplimiento de los actos jurídicos con criptomonedas, sin más límites que los establecidos en esta ley y en aquellas que regulen el tipo de acto.
Artículo 7°. Representación en moneda legal de las criptomonedas. El valor de las criptomonedas puede ser tasado en la moneda legal colombiana, para lo cual, las partes podrán establecer dichos valores, ya sea al momento de adquirir la obligación o al de la ejecución de la misma. Si no se establece, se entenderá la tasada al momento del cumplimiento del acto jurídico.
El Banco de la República deberá certificar los valores de las criptomonedas utilizadas, ya sean en pesos colombianos o en divisas legales de otros Estados.

DECREES
First Act of Cryptocurrencies or Virtual Currencies
Title 1
Use of Cryptocurrencies or Virtual Currencies in Colombia
Section 1. Purpose. The purpose of this Act is to regulate civil and commercial transactions and operations using cryptocurrencies or virtual currencies, between private and public persons, for the purchase of goods and services, in all Colombian territory, as well as the provisions for protection, monitoring, inspection, and oversight over said operations.
Section 2. Principles. Transactions in cryptocurrencies or virtual currencies shall be based on the principles of inclusion and innovation in the transactional forms that have been developed via new technological advances, on the promotion of private ownership, on improvement of methods of consumer protection, and on the prevention of fraud.
Section 3. Definitions. For purposes of this Act, the following definitions shall apply:
3.1 Cryptocurrencies or Virtual currencies. Virtual asset, or asset in digital form, represented as an electronically recorded value, usable by people as a form of payment for any type of legal transaction, and whose transfer can only be made through electronic means.
3.2 Blockchain. Distributed database made up of appended packages of data (“blocks”), designed in such a way as to prevent modification. A block with a reliable and publicly visible timestamp is created and added onto the end of the “chain.”
3.3 Cryptocurrency wallet. Virtual system for the storage of different cryptocurrencies or virtual currencies, used as a means to transfer funds.
3.4 Trading. Action of buying and selling virtual currencies on different exchange platforms.
3.5 Traders. Natural persons who, by virtue of their knowledge and experience, make trades, either of their own accord or through a cryptocurrency management service or brokerage firm.
3.6 Purchaser. Natural or juridical person who, having advance informed consent, acquires cryptocurrencies or virtual currencies in order to use said currencies, whether to acquire or exchange goods or services or to make trades.
Section 4. Cryptocurrency Brokers. Natural persons or for-profit juridical persons who work as merchants under trade rules set forth by the Chamber of Commerce (Cámara de Comercio). These persons’ corporate purpose may be to sell, manage, or trade cryptocurrencies, given prior authorization from the Ministry of Information and Communications Technology (Ministerio de Tecnologías de la Información y de las Comunicaciones).
Brokerage firms may also sell, manage, or trade virtual currencies under the written commission between firm and purchaser, wherein are expressly written the obligations of both parties, the risks assumed by each party, and the need to manage risks through collateral.
Cryptocurrency brokers must be able to transfer to the purchaser, upon the purchaser's request, the amount of virtual currencies that the purchaser owns, or the amount in national currency equivalent to the payment received from the sale of said cryptocurrencies.
These firms or commercial institutions must have the Anti–Money Laundering and Counter Terrorism Financing Risk Management System known as SARLAFT, approved by the Information and Financial Analysis Unit (UIAF). The UIAF may make recommendations for obtaining SARLAFT approval.
Paragraph 1. Cryptocurrency brokers are prohibited from selling, assigning, transferring, alienating, pledging, or affecting the purchaser’s use and enjoyment of virtual currencies under their management unless given express legal capacity by the purchaser.
Paragraph 2. Right to Be Informed. In print or digital form, the firms or commercial institutions considered in this Section must explain the technical aspects of cryptocurrency exchange and the risks run by people purchasing this type of currency.
Paragraph 3. The businesses or commercial institutions whom this section considers must inform the Office of the Attorney General of any unusual movement detected in their transactions and that might be indicative of money laundering, financing of terrorism, and other crimes related to these two activities, under penalty of sanctions including the dissolution and liquidation of the business, removal from the company register, and other applicable legal proceedings.
The Ministry of Information and Communications Technology, within the six (6) months following this Act’s passage, must regulate the requirements that businesses or commercial institutions must meet in order to obtain authorization to exchange cryptocurrencies in Colombia.
Section 5. Informed Consent. Cryptocurrency brokers must inform the purchaser of the specifications of exchanging virtual currency, the manners in which the brokers can acquire cryptocurrencies, and all information necessary to fully understand the use of virtual currencies.
Therefore, purchasers must be informed of the following:
a. Cryptocurrencies are not legal tender used by the Colombian State and therefore are not backed by the National Government nor the Central Bank of Colombia.
b. Transactions are not reversible once conducted.
c. Virtual currencies and the market in which these currencies operate are volatile, and their oversight is subject to the rules inherent in that market.
d. There exist inherent technological, cybernetic, and fraud risks in transactions involving cryptocurrencies.
This informed consent must continue to be updated as new risks for cryptocurrency transactions arise.
Section 6. Operations or Transactions with Virtual Currencies Operations or transactions through which both or all parties express their free and informed willingness to conduct transactions with virtual currency, enabling related legal transactions, provided that said transactions only concern licit and legal pursuits.
The parties are free without limit to stipulate the conditions for conducting legal cryptocurrency transactions beyond the limits set forth in this Act and in those Laws regulating such acts.
Section 7. Representation of Cryptocurrencies in Legal Currency Cryptocurrencies’ value can be linked to legal Colombian currency, for which purpose the parties may establish said values, at the time the transaction is either arranged or performed. If a value is not established, the linked currency shall be worth the value held at the time the legal transaction is fulfilled.
The Central Bank of Colombia must certify the values of cryptocurrencies used, whether in Colombian pesos or in legal currencies of other States.

Source text - Spanish Los datos ambientales presentados en la Tabla 1 muestran que la laguna Alalay es un ecosistema hipereutrófico con valores muy superiores a aquellos presentados en la literatura [66]. Al haberse cortado el ingreso de las aguas del río Rocha (cargadas de contaminantes y nutrientes) ya desde el año 2015, planteamos que actualmente la mayor parte de los nutrientes en la laguna provienen de la escorrentía superficial y subsuperficial, así como de los sedimentos y reciclaje de la biomasa autóctona [43]. Esto tiene implicaciones directas sobre los protocolos de manejo y recuperación de la laguna que deben concentrarse en el manejo de sedimentos y gestión de la cuenca (basura, efluentes, alcantarillado, etc.). Las altas concentraciones de nutrientes posiblemente desencadenaron la FAN observada en la laguna. Las concentraciones de células están por encima de valores reportados en ambientes eutróficos y que muy pocas veces se presentan en la literatura (número de células por mL superior al millón, Tabla 2). El efecto de la evaporación del agua por las altas temperaturas persistentes desde finales del 2015 y de la sequía atípica del año 2016 (influenciada por el Niño), ha sido el de concentrar nutrientes (ver por ejemplo los valores de amonio, nitratos, fósforo total y carbonatos en la Tabla 1 hacia el final del estudio) y de aumentar aún más la biomasa algal, incrementando las tasas reproductivas (ver los elevados números de células hacia el final del estudio en la Tabla 2).
El bloom no ha cedido durante el periodo de estudio y ha estado permanentemente dominado por Arthrospira fusiformis (Voronikhin) Komárek & J.W.G. Lund (Tabla 2, Figs 3A-D). Esto se debe a la autecología del alga (alcalifila, halófila y eutraféntica) y a la efectividad con la que esta alga se reproduce por vía asexual ya sea por hormogonios (filamentos móviles, cortos) (Fig. 3D), o por acinetos (células de dormacia grandes) (Fig. 3F). También, el alga está asociada con Anabaenopsis milleri Voronikhin (Figs 3E y 3F), otra cianobacteria de autecología similar a la de A. fusiformis, la cual también se reproduce asexualmente y fija nitrógeno atmosférico mediante heterocitos terminales (Figs 3E y 3F). La actividad diazotrófica de esta segunda cianobacteria, junto a la de las bacterias acompañantes (Fig. 3E), parece haber cambiado el balance de nutrientes en la laguna. Esto debido a que ahora los nitratos y amonio son muy abundantes comparados con situaciones previas al bloom [44]. También, una especie no identificada de la cianobacteria Aphanocapsa Nägeli (Fig. 3C) ha ido incrementando su abundancia paulatinamente en los 3 puntos de muestreo (Tabla 2). La densidad de Phacus sp. y Euglena sp., dos organismos flagelados que generalmente prefieren ambientes con altas cargas de materia orgánica, ha sido menor.
Adicionalmente, la dominancia de A. fusiformis y A. milleri se ve favorecida por la presencia en el citoplasma de aerotopos, vesículas gaseosas que les permiten mantenerse en la parte superior de la columna de agua, bloqueando la penetración de la luz y por ende, el desarrollo de cualquier otro tipo de alga en grandes cantidades [50][64]. Aphanocapsa sp. no posee aerotopos pero debido a su pequeño tamaño puede mantenerse suspendida entre las colonias de las otras dos cianobacterias o apoyada sobre el mucilago que estas producen (Fig. 3C). Las algas eucariontes, generalmente, no resisten la alta intensidad de la radiación solar que llega a la parte superior de la columna de agua pero en las cianobacterias los tilacoides (estructuras alargadas que contienen a los pigmentos fotosintéticos, incluyendo carotenoides y estructuras proteicas complejas denominadas ficobilisomas) están dispuestos en varias capas por debajo de la membrana celular. Estas capas constituyen una especie de quitasol que protege los contenidos celulares, evitando la fotooxidación de la clorofila [57].
Las tres cianobacterias identificadas en Alalay son tóxicas. Arthrospira fusiformis secreta neurotoxinas (anatoxina-a y homoanatoxina-a) y hepatotoxinas (microcistinas); A. milleri y Aphanocapsa sp. producen hepatotoxinas (microcistinas)[17][40]. Las dos primeras especies han sido asociadas con muertes masivas de peces, aves [10][35][47] y humanos [69]. La inexistencia de laboratorios especializados en Bolivia y la dificultad de enviar muestras líquidas o liofilizadas al exterior, nos impidieron constatar directamente la presencia de las cianotoxinas en agua y sedimentos. Ante la abundancia de las algas tóxicas, su toxicidad reportada en la literatura y las características de los órganos internos de peces y aves muertas (Dr. Vet. E. Alandia com. pers.), es lógico concluir que tal deceso fue principalmente producido por efecto de las cianotoxinas, más que por otras causas como el descenso de los niveles de oxígeno disuelto o la presencia de sulfuro de hidrógeno (ver discusión abajo).
Con respecto a la variación de los factores ambientales y su influencia en la distribución de especies (Fig. 4), el primer eje de correspondencia canónica está fuertemente relacionado (correlaciones ponderadas entre 0,6–0,95) con nitratos, fósforo total, carbonatos, sulfatos y conductividad, en orden de importancia decreciente. El segundo eje, por otra parte, está débilmente relacionado (correlaciones ponderadas entre 0,25–0,46) con el fósforo soluble y el pH. Factores como oxígeno disuelto, amonio y temperatura tienen muy poca influencia en el patrón de distribución observado.
Translation - English The environmental data presented in Table 1 show that Lake Alalay is a hypereutrophic ecosystem with nutrient levels much higher than those normally reported in the literature [66]. Since the inflow of water from the Rocha River (carrying pollutants and nutrients) was cut off beginning in 2015, this study hypothesizes that the greater part of the lake’s nutrients currently come from surface and subsurface runoff (in addition to sediments and recycled autochthonous biomass) [43]. This has direct implications for the lake’s management and restoration protocols, which should be focused on controlling the sediments and caring for the watershed management (garbage, wastewater, sewage, etc.). The high concentrations of nutrients possibly triggered the HAB observed in the lake. Cell concentrations are higher than levels reported in the literature (number of cells per mL over one million, Table 2). The effect of water evaporation caused by persistent high temperatures since late 2015 and the atypical drought in 2016 (influenced by El Niño) has been a rise in nutrient levels (for instance of ammonium, nitrates, total phosphorus, and carbonates in Table 1 in the later stages of this study) and a further increase in algal biomass, raising reproductive rates (see Table 2 for the elevated number of cells in the later stages of this study).
The bloom has not subsided during the period of study and for its duration has been dominated by Arthrospira fusiformis Voronichin (Komárek & J.W.G. Lund) (Table 2, Figs. 3A-D). This is due to the alga’s autecology (alkaliphilic, halophilic and eutraphentic) and its effectiveness at asexual reproduction, whether by means of hormogonia (short mobile filaments) (Fig. 3D) or akinetes (large dormant cells) (Fig. 3F). Additionally, the alga is associated with Anabaenopsis milleri Voronichin (Figs. 3E-F), another cyanobacterium with an autecology similar to that of A. fusiformis, as it also reproduces asexually and fixes atmospheric nitrogen via terminal heterocytes (Figs. 3E-F). Diazotrophic activity by A. milleri, in conjunction with the bacteria that accompany it, seems to have changed the balance of nutrients in the lake. Nitrates and ammonium are very abundant now compared with before the bloom [44]. In addition, an unidentified species of the cyanobacterium Aphanocapsa Nägeli (Fig. 3C) has been gradually increasing in abundance in the three sampling sites (Table 2). The density of Phacus sp. and Euglena sp., two flagellates generally preferring environments rich in organic material, has been lower.
Additionally, the dominance of A. fusiformis and A. milleri is aided by the presence of aerotopes in their cytoplasm, gas vesicles that allow them to stay in the upper part of the water column, blocking light penetration and, by extension, impeding the development of any other type of algae in large quantities [50][64]. Aphanocapsa sp. does not possess aerotopes, but due to its small size it is able to stay suspended between colonies of the other two types of cyanobacteria or support itself in mucilage secreted by them (Fig. 3C). Eukaryotic algae, in general, cannot withstand the high intensity of solar radiation reaching the upper part of the water column, but cyanobacteria possess thylakoids (elongated structures containing photosynthetic pigments, including carotenoids and complex protein structures called phycobilisomes) arranged in several layers beneath the cellular membrane. These layers form a sort of umbrella to protect the inside of the cells, preventing photo-oxidation of chlorophyll [57].
The three cyanobacteria identified in Alalay are toxic. Arthrospira fusiformis secretes neurotoxins (anatoxin-a and homoanatoxin-a) and hepatotoxins (microcystins), while A. milleri and Aphanocapsa sp. produce hepatotoxins (microcystins) [17][40]. A. fusiformis and A. milleri have been associated with bird and fish kills [10][35][47] as well as human deaths [69]. The absence of specialized laboratories in Bolivia and the difficulty of sending liquid or freeze-dried samples abroad prevented the direct conclusion that cyanotoxins were present in the water and sediments. Given the toxic algae’s abundance, their toxicity reported in the literature, and the characteristics of the internal organs in dead fish and birds (E. Alandia, pers. comm.), it is logical to conclude that their deaths were due primarily to cyanotoxins rather than other causes such as the decrease in dissolved oxygen levels or the presence of hydrogen sulfide (see Discussion below).
Regarding the variation in environmental factors and their influence on the distribution of species (Fig. 4), axis 1 of canonical correspondence is strongly related to, in decreasing order, nitrates, total phosphorus, carbonates, sulfates, and conductivity (weight correlations range between 0.6–0.95). In contrast, axis 2 is weakly related to soluble phosphorus and pH (weight correlations range between 0.25–0.46). Factors such as dissolved oxygen, ammonium, and temperature have very little influence in the observed distribution pattern.

Tous différends découlant du présent contrat ou en relation avec celui-ci seront tranchés définitivement suivant le Règlement d’arbitrage de la Chambre de commerce internationale par un ou plusieurs arbitres nommés conformément à ce Règlement.
Les parties sont libres d’adapter la clause selon les circonstances du cas. Par exemple, elles peuvent souhaiter préciser le nombre d’arbitres, sachant que le Règlement d’arbitrage privilégie la solution de l’arbitre unique. Il peut être souhaitable également que les parties mentionnent le lieu et la langue de l’arbitrage ainsi que la loi applicable au fond du litige. Le libre choix par les parties du lieu et de la langue de l’arbitrage, comme du droit applicable, n’est pas limité par le Règlement d’arbitrage de la CCI.
Il convient de prêter une attention particulière à éviter tout risque d’ambiguïté dans le libellé de la clause lors de son adaptation. Une formulation obscure est source d’incertitudes et de retards et peut entraver, voire compromettre, le processus de règlement des différends.
Les parties doivent également vérifier tous les facteurs pouvant peser sur la force exécutoire de la clause au regard de la loi applicable, y compris, notamment, toute règle impérative du lieu de l’arbitrage et du ou des lieux ou l’exécution est susceptible d’être demandée.
Translation - English ARBITRATION CLAUSE
Any dispute or controversy arising from or relating to this contract shall be settled by binding arbitration in accordance with the International Chamber of Commerce’s Rules of Arbitration by one or more arbitrators selected in accordance with these Rules.
The parties are free to adapt this clause according to their particular circumstances. For example, they may wish to stipulate the number of arbitrators, given that the Rules of Arbitration contain a presumption of a sole arbitrator. It may also be desirable that the parties state the place and language of arbitration as well as the law applicable to the merits of the dispute. The parties’ free choice of place and language of arbitration, as of the applicable law, is not limited by the ICC’s Rules of Arbitration.
Parties should pay particular attention to avoid any risk of ambiguity in the clause’s wording at the time of its drafting. Unclear wording may cause uncertainty and delay and may hinder, or even jeopardize, the dispute resolution process.
The parties must also examine all factors that may affect the clause’s enforceability under the applicable law, including, especially, all mandatory rules that may exist at the place of arbitration and at the expected place or places of performance.

Regarding the judgment rendered by the Paris Commercial Court on October 12, 2011, which, under the terms of an interlocutory injunction:
found P**********g’s claims inadmissible,
ordered P**********g to pay G**********s in euros by way of cash or discharge on the payment date the equivalent of the amount of USD 963,000 plus interest at the legal rate beginning on December 6, 2001, and with capitalization of interests unpaid for more than one year,
ordered P**********g to pay G**********s the amount of EUR 50,000 pursuant to Article 700 of the [French] Civil Procedure Code.
Regarding the appeal of this judgment, lodged by P**********g on January 30, 2012.
Regarding G**********s’s arguments, dated June 29, 2012, in which it was requested that the pre-trial judge:
order the striking of this case until P**********g proves performance of the judgment rendered,
order P**********g to pay G**********s the amount of EUR 3,000 pursuant to Article 700 of the Civil Procedure Code.
Regarding P**********g’s writings, dated September 12, 2012, in which it was requested that the pre-trial judge:
