El proceso para elegir al nuevo fiscal general de Guatemala está lleno de sombras y preguntas. El primer filtro es la comisión de postulación integrada por los decanos de 12 facultades de derecho. Translation - English University Deans and Guatemala’s Convoluted Road to a New Attorney General
Guatemala is on the verge of electing a new attorney general. The first filter in the selection process is the postulation commission, made up primarily of the deans from the country’s 12 law schools. As this important process continues, serious questions have emerged regarding these deans, the legitimacy of the universities they represent and the pressures imposed upon them by political interest and organized crime groups.
On the fourth floor of an office building in the financial district of Guatemala City, armed men from a private security company guard Da Vinci University’s most important asset: its law school.
Da Vinci University is relatively new, as is its law school. The nonprofit organization from which it was created was legally registered in 2008. Yet, in just the first five years of its existence, it is said to have opened 70 campuses covering every department in Guatemala. In 2017, it graduated no less than 541 attorneys, a figure lower only than that of the University of San Carlos of Guatemala, the largest, oldest, and only public institution in the country.

One important milestone is the preparation of this Work Plan for the 2016-2018 period, using the focal points from the Environmental Training Network (operative paragraph 2), whose elements are in great part defined in said decision, as consultation; the Work Plan has been focused by grouping those elements into 5 large lines of work:
i) training and research;
ii) coordination with universities;
iii) coordination with other initiatives and non-traditional sectors (private sector, secretaries of multilateral environmental agreements);
iv) experience exchange and South-South cooperation (including systematization of policies and experiences);
v) funding.
3. In addition, work with the English Caribbean in coordination with the Subregional Office for the Caribbean will need to expand.
4. In terms of resources, given the limitations on the Environmental Training Network trust fund (its principal funding source), the focus will be kept on regional or subregional activities based on and in cooperation with existing initiatives, while constructing alliances with various programs and actors within and outside of PNUMA.

Special Education Due Process Procedures - Fact sheet
This document provides general information regarding due process procedures. For
additional information, please review the Special Education Dispute Resolution Manual.
This can be found on the Office for Dispute Resolution (ODR) website (www.odr-pa.org)
or a hard copy will be mailed to interested parties upon request, by calling ODR at 1-800-
222-3353.
The parent or local educational agency (LEA) may request a due process hearing with respect to any
matter relating to the identification, evaluation, or educational placement of the child or the provision of a
free appropriate public education (FAPE) by filing a "Due Process Complaint Notice”. A due process
hearing will not proceed until all required information is provided and procedures followed.
Timeline for requesting Due Process. The parent or LEA must request a due process hearing through the
filing of a Due Process Complaint Notice within two (2) years of the date the parent or the LEA knew or
should have known about the alleged action that forms the basis of the Due Process Complaint Notice.
There are limited exceptions to this timeline. This timeline will not apply to the parent if the parent was
prevented from requesting the due process hearing due to the specific misrepresentations by the LEA
that it had resolved the problem forming the basis of the Due Process Complaint Notice; or if the LEA
withheld information from the parent which was required to be provided to the parent.
Service of A Due Process Complaint Notice. A copy of the Due Process Complaint Notice must be sent to
the other party and, at the same time, to the Office for Dispute Resolution.
Contents of A Due Process Complaint Notice. The Due Process Complaint Notice must contain, at a
minimum, the following information:
1. The name of the child; the address where the child lives, and the name of the school
the child is attending;
2. If the child or youth is homeless, available contact information for the child and the
name of the school the child is attending;
3. A description of the nature of the problem, including facts relating to such problem; and
4. A proposed resolution of the problem to the extent known and available to the party
filing the Notice.
Challenging Sufficiency of the Due Process Complaint Notice. The Due Process Complaint Notice will be
considered to be sufficient unless the party receiving it notifies the Hearing Officer and the other party in
writing within fifteen (15) days of receipt that the receiving party believes the Notice does not meet the
requirements listed above.
Response to Complaint Notice. If the LEA has not sent a prior written notice (NOREP) to the parent
regarding the subject matter contained in the parents Due Process Complaint Notice, the LEA must send
to the parent, within ten (10) days of receiving the Due Process Complaint Notice, a response including
the following information: an explanation of why the LEA proposed or refused to take the action raised in
the parents Due Process Complaint Notice; a description of other options the Individualized Education
Program (IEP) Team considered and the reasons why those options were rejected; a description of each
evaluation procedure, assessment, record, or report the LEA used as the basis for the proposed or
refused action; and a description of the factors that are relevant to the LEAs proposal or refusal.

Filing this response to the parents Due Process Complaint Notice does not prevent the LEA from
challenging the sufficiency of the Due Process Complaint Notice. If the LEA has already sent prior notice
(NOREP) to the parent, or it is the parent receiving the Due Process Complaint Notice, then a response
to the Due Process Complaint Notice must be sent to the other side within ten (10) days of receipt of the
notice. The response should specifically address the issues raised in the Due Process Complaint Notice.
Hearing Officer Determination of Sufficiency of A Due Process Complaint Notice. Within five (5) days of
receiving a party’s challenge to the sufficiency of the Due Process Complaint Notice, the Hearing Officer
must make a determination based solely on the information contained within the Complaint Notice,
whether the notice meets requirements. The Hearing Officer must immediately notify both parties in
writing of his or her determination.
Amended Due Process Complaint Notice. Either the parent or a LEA may amend its Due Process
Complaint Notice only if: the other party consents in writing to the amendment and is given the
opportunity to resolve the issues raised in the Due Process Complaint Notice through a preliminary
meeting/resolution session; or the Hearing Officer grants permission for the party to amend the Due
Process Complaint Notice. However, the Hearing Officer may grant this permission not later than five (5)
days before a due process hearing occurs.
Subject Matter of the Hearing. The party requesting the due process hearing is not permitted to raise
issues at the due process hearing that were not raised in the Due Process Complaint Notice (or Amended
Due Process Complaint Notice) unless the other party agrees otherwise.
Resolution Session (applicable to parent requests for due process only). Before a due process hearing
will take place, the LEA must convene a resolution meeting, unless both the parent and LEA agree in
writing to waive it or agree to use mediation in lieu of the resolution meeting. The purpose of the meeting
is to afford the LEA the opportunity to resolve the dispute without the need for a due process hearing. The
law requires the relevant member or members of the Individualized Education Program (IEP) Team who
have specific knowledge of the facts identified in the Due Process Complaint Notice to attend the
meeting. The resolution meeting must be convened within fifteen (15) days of the LEA receiving the
parents’ Due Process Complaint Notice. A representative of the LEA who has decision-making authority
must be present at this meeting. The LEA may not have an attorney attend the meeting unless the parent
is also accompanied by an attorney. At the meeting, the parent will discuss the Due Process Complaint
Notice, and the LEA will be provided the opportunity to resolve the Due Process Complaint Notice.
If both parties believe the use of a neutral third party will increase the likelihood of reaching agreement at
the resolution meeting, the Office for Dispute Resolution (ODR) will send a facilitator upon request. There
is no charge to either party for the use of the facilitator.
If the parent and LEA resolve the issues in the Due Process Complaint Notice at the resolution meeting,
they must put the agreement terms in writing, and both the parent and a representative of the LEA who
has the authority to bind the LEA must sign the agreement. The agreement is a legally-binding document
and may be enforced by a court.
Either the parent or LEA may void the agreement within three (3) business days of the date of the
agreement. After three (3) days, the agreement is binding on both parties.
Administrative Matters at Preliminary Meetings, Mediation and Due Process. When carrying out
administrative matters such as scheduling, exchange of witness lists, and status conferences, the parent
and LEA may agree to use alternative means of meeting participation, such as videoconferences and
conference calls. The format for any of these activities involving the hearing officer will, to the extent such
falls within his or her discretion, be decided by the hearing officer.

Timeline for Completion of Due Process Hearing. If the LEA has not resolved the Due Process Complaint
Notice within thirty (30) days of receiving it, or within thirty (30) days of receiving the Amended Due
Process Complaint Notice, the due process hearing may proceed and applicable timelines commence.
The timeline for completion of due process hearings is forty-five (45) days, unless the Hearing Officer
grants specific extensions of time at the request of either party.
Disclosure of Evaluations and Recommendations. Not less than five (5) business days prior to a due
process hearing, each party must disclose to all other parties all evaluations completed by that date, all
recommendations based on those evaluations, as well as all other documents and witnesses, that the
offering party intends to introduce or call at the due process hearing. Failure to disclose this information
may result in a Hearing Officer prohibiting the party from introducing the information at the hearing unless
the other party consents to its introduction.
Due Process Hearing Rights. Generally, special education due process hearings for children with
disabilities, or thought to be children with disabilities, must be conducted and held in the LEA at a place
and time reasonably convenient to the parent and child involved. The hearing must be an oral, personal
hearing and must be closed to the public unless the parent requests an open hearing. If the hearing is
open, the decision issued in the case, and only the decision, will be available to the public. If the hearing
is closed, the decision will be treated as a record of the child and may not be available to the public. The
decision of the Hearing Officer must include findings of fact, discussion and conclusions of law. Although
technical rules of evidence will not be followed, the decision must be based upon the substantial evidence
presented at the hearing. A written, or at the option of the parent, electronic verbatim record of the
hearing will be provided to the parent at no cost to the parent. Parent may be represented by legal
counsel, and/or accompanied to and advised at the hearing by individuals with special knowledge or
training with respect to the problems of children with disabilities. Parents or parent representatives must
be given access to educational records, including any tests or reports upon which the proposed action is
based. A party has the right to compel the attendance of and question witnesses who may have evidence
upon which the proposed action might be based. A party has the right to present evidence, witnesses,
and to confront and cross-exam opposing witnesses, which includes the presentation of expert medical,
psychological or educational testimony.
Hearing Procedures. The hearing officer assigned will inform the parties about procedural matters related
to the hearing, and matters relating to hearing management that are within his or her discretion.
Decision of Hearing Officer. A decision made by a Hearing Officer must be made on substantive grounds,
based upon a determination of whether the child received a free appropriate public education (FAPE). In
disputes alleging a procedural violation, a Hearing Officer may find that a child did not receive a free
appropriate public education (FAPE) only if the procedural inadequacies impeded the child’s right to a
free appropriate public education (FAPE); significantly impeded the parents opportunity to participate in
the decision-making process regarding the provision of a free appropriate public education (FAPE) to the
parents’ child; or caused a deprivation of educational benefits. A Hearing Officer may still order a LEA to
comply with procedural requirements even if the Hearing Officer determines that the child received a free
appropriate public education (FAPE). The parent may still file a Complaint with the Bureau of Special
Education regarding procedural violations.
Civil Action. Either the parent or LEA who disagrees with the findings and decision of the Hearing Officer
has the right to file an appeal in state or federal court. Sometimes the issues in a due process case deal
not only with special education issues, but also regarding a child’s status and/or claim as a gifted child. In
that instance, the final order of the Hearing Officer -- to the extent it deals with issues of giftedness -- can
only be appealed to Commonwealth Court. For all other appeals, the party filing an appeal is encouraged
to seek legal counsel to determine the appropriate court with which to file an appeal. A party has ninety
(90) days from the date of the Hearing Officer’s decision to file an appeal in federal court. While this time
period for so appealing to Pennsylvania Commonwealth Court is likely the same, since it is unclear
whether state rules seeking to establish a uniform thirty (30) day period for filing appeals to that Court
apply, a party appealing to it may wish to do so in this shorter time frame.

Attorneys Fees. A court, in its discretion, may award reasonable attorneys fees as part of the costs: to a
prevailing party who is the parent of a child with a disability; to a prevailing party who is a State
Educational Agency or LEA against the attorney of the parent who files a Due Process Complaint Notice
or subsequent cause of action that is frivolous, unreasonable, or without foundation, or against the
attorney of the parent who continued to litigate after the litigation clearly became frivolous, unreasonable
or without foundation; or to a prevailing State Educational Agency or LEA against the attorney of the
parent, or against the parent, if the parents Due Process Complaint Notice or subsequent cause of action
was presented for any improper purpose, such as to harass, to cause unnecessary delay, or to
needlessly increase the cost of litigation. Fees awarded will be based on rates prevailing in the
community in which the action or proceeding arose for the kind and quantity of attorney services
furnished.
The federal law imposes certain requirements upon the parent and LEA and in some circumstances may
limit attorney fee awards. Parents should consult with their legal counsel regarding these matters. The
following rules apply: Attorneys fees may not be awarded and related costs may not be reimbursed in any
action or proceeding for services performed subsequent to the time of a written offer of settlement to the
parent if the offer is made within the time prescribed by Rule 68 of the Federal Rules of Civil Procedures,
or, in the case of an administrative hearing, at any time more than ten (10) days before the proceeding
begins; the offer is not accepted within ten (10) days; and the court finds that the relief finally obtained by
the parent is not more favorable to the parent than the offer of settlement. An award of attorneys’ fees
and related costs may be made to the parent who is the prevailing party and who was substantially
justified in rejecting the settlement offer. Attorneys’ fees may not be awarded relating to any meeting of
the Individualized Education Program (IEP) team unless the meeting is convened as a result of an
administrative proceeding or judicial action. A due process resolution session is not considered to be a
meeting convened as a result of an administrative hearing or judicial action, nor an administrative hearing
or judicial action for purposes of reimbursing attorneys fees. The Court may reduce the amount of any
attorneys’ fee award when:
the parent, or the parents’ attorney, during the course of the action or proceeding unreasonably
protracted the final resolution of the controversy; the amount of the attorneys fees otherwise authorized to
be awarded unreasonably exceeds the hourly rate prevailing in the community for similar services by
attorneys of reasonably comparable skill, reputation and experience; the time spent and legal services
furnished were excessive considering the nature of the action or proceeding; or the attorney representing
the parent did not provide to the local educational agency the appropriate information in the Due Process
Complaint Notice. These reductions do not apply in any action or proceeding if the court finds that the
State or LEA reasonably protracted the final resolution of the action or proceeding.
Child’s Status during Administrative Proceedings. When a hearing officer agrees with the child’s parents
that a change of placement is appropriate, the child is afforded that placement even if the LEA files an
appeal of the decision. See 34 CFR §518 (d). Within thirty (30) days of the hearing officer decision, an
assurance form must be executed by the Superintendent or Chief Executive Officer, and returned to the
assigned Office for Dispute Resolution Case Manager, assuring that the child has been afforded the
ordered placement regardless of any appeal. Questions about this process should be directed to the
LEA’s legal counsel.

enviado el aviso previo escrito (NOREP) a los padres, o si son los padres que reciben el Aviso de
Queja del Proceso Legal Debido, una respuesta al Aviso de Queja del Proceso Legal Debido
debe ser enviada a la otra parte dentro de diez (10) días después de haber recibido el aviso. La
respuesta debe dedicarse a los temas puestos en el Aviso de Queja del Proceso Legal Debido.
La Determinación de la Suficiencia de un Aviso de Queja del Proceso Legal Debido por el Oficial

de la Audiencia da permiso a una de las partes de enmendar el Aviso de Queja del Proceso
Legal Debido. Sin embargo, el Oficial de la Audiencia puede dar su permiso dentro de cinco (5)
días antes de una audiencia del proceso legal debido.
Tema de la Audiencia: No se le permite a la parte que solicitó la audiencia del proceso legal
debido plantear temas a la audiencia del proceso legal debido que no fueron puestos en el Aviso

usar la mediación en vez de la reunión de resolución. El propósito de la reunión es dar a la LEA
la oportunidad de resolver la disputa sin la necesidad de proceder a una audiencia del proceso
legal debido. La ley requiere que el miembro/los miembros pertinente(s) del Equipo del
Programa de Educación Individualizado (IEP, por sus siglas en inglés) que conocen los datos
identificados en el Aviso de Queja del Proceso Legal Debido asistan a la reunión. La reunión de
resolución debe ocurrir dentro de quince (15) días a partir de que la LEA reciba el Aviso de Queja
del Proceso Legal Debido de los padres. Un representante de la LEA que tenga la autoridad de
tomar decisiones debe estar presente en esta reunión. La LEA no puede tener un abogado en la
reunión a menos que los padres también tengan un abogado. En la reunión, los padres
discutirán el Aviso de Queja del Proceso Legal Debido, y la LEA tendrá la oportunidad de
resolver el Aviso de Queja del Proceso Legal Debido.
Si ambas partes creen que el uso de una tercera parte neutral aumentará la probabilidad de
llegar a un acuerdo en la reunión de resolución, la Oficina para la Resolución de Disputas (ODR)
asignará un facilitador a solicitud de las dos partes. Ninguna parte debe pagar honorarios por el
uso de un facilitador.

Si los padres y la LEA resuelven los temas en el Aviso de Queja del Proceso Legal Debido en la
reunión de resolución, deben escribir las condiciones del acuerdo y tanto los padres como el
representante de la LEA que tiene la autoridad vinculante en la LEA deben firmar el acuerdo. El
acuerdo es un documento legalmente vinculante y puede ser impuesto por un tribunal.
Los padres o la LEA pueden anular el acuerdo dentro de tres (3) días laborables a partir de la
fecha del acuerdo. Después de tres (3) días, el acuerdo será vinculante para ambas partes.
Asuntos Administrativos en las Reuniones Preliminares, Mediaciones, y el Proceso Legal Debido:
Al realizar asuntos administrativos como programación, intercambios de listas de testigos, y
conferencias de estatus, los padres y la LEA pueden acordar usar medidas alternas de
participación, como conferencias por video y por teléfono. El formato de alguna de estas
actividades que involucren al oficial de la audiencia, en la medida en que tales actividades estén
bajo su discreción, será decidido por el oficial de la audiencia.
Cronología para Completar la Audiencia del Proceso Legal Debido: Si la LEA no ha resuelto el
Aviso de Queja del Proceso Legal Debido dentro de treinta (30) días de haberlo recibido, o
dentro de treinta (30) días después de haber recibido el Aviso Enmendado de Queja del Proceso
Legal Debido, la audiencia del proceso legal debido puede proceder y las cronologías aplicables
pueden comenzar. La cronología para la finalización de audiencias del proceso legal debido es
cuarenta y cinco (45) días, a menos que el Oficial de la Audiencia conceda extensiones
específicas a cualquier parte.
Divulgación de Evaluaciones y Recomendaciones: No menos de cinco (5) días laborables antes
de una audiencia del proceso legal debido, cada parte debe divulgar a todas las otras partes
todas las evaluaciones completadas antes de esa fecha, todas las recomendaciones basadas en
dichas evaluaciones y todos los demás documentos y testigos que la otra parte tenga la
intención de presentar en la audiencia del proceso legal debido. El incumplimiento para divulgar
esta información puede resultar en que un Oficial de la Audiencia prohíba que la parte presente
dicha información en la audiencia a menos que la otra parte acceda a que sea presentada.
Derechos de la Audiencia del Proceso Legal Debido: Generalmente, las audiencias del proceso
legal debido para niños(as) con impedimentos, o si se cree que puedan tener impedimentos,
deben ser programadas y completadas en la LEA en un lugar y hora razonablemente
conveniente para los padres y el niño(a) involucrado. La audiencia debe ser oral y personal, y
debe ser cerrada al público a menos que los padres pidan una audiencia abierta. Si la audiencia
es abierta, la decisión dictada en el caso, y solamente la decisión, estará disponible al público.
Si la audiencia es cerrada, la decisión será tratada como un archivo del niño(a) y no puede
hacerse disponible al público. La decisión del Oficial de la Audiencia debe incluir
determinaciones de hecho, discusión, y conclusiones de la ley. Aunque reglas técnicas de
evidencia no serán seguidas, la decisión debe ser basada en la evidencia substancial presentada
en la audiencia. Un archivo escrito—o, electrónico, según la opción de los padres—y textual de
la audiencia será provisto a los padres sin costo alguno para ellos. Los padres pueden ser
representados por un asesor legal, y/o acompañados y aconsejados a la audiencia por individuos
con conocimientos o entrenamientos especiales con respecto a los problemas de los jóvenes con
impedimentos. Se debe dar a los padres o a los representantes de los padres acceso a los
archivos educativos, incluso exámenes o reportes en los cuales está basada la acción propuesta.
Una parte tiene el derecho de requerir la asistencia de testigos, que puedan tener evidencia en la
cual la acción propuesta está basada, e interrogarlos. Una parte tiene el derecho de presentar
evidencia y testigos, y de enfrentar y repreguntar a testigos de la parte opositora, incluso la
presentación de testimonios de expertos médicos, psicológicos, y educativos.
Procedimientos de la Audiencia: El oficial asignado a la audiencia informará a las dos partes
sobre los procedimientos relacionados a la audiencia, y sobre los asuntos relacionados a la
administración de la audiencia que están bajo su discreción.

Decisión del Oficial de la Audiencia: Una decisión tomada por el Oficial de la Audiencia debe ser
tomada por motivos substanciales, basada en una determinación de si el niño(a) recibió una
educación pública, apropiada, y gratis (FAPE, por sus siglas en inglés). Para disputas que
alegan una violación de procedimiento, un Oficial de la Audiencia puede declarar que un niño(a)
no recibió una educación pública, apropiada, y gratis solamente si las insuficiencias de
procedimiento impidieron el derecho del niño(a) a una educación pública, apropiada, y gratis; si
impidieron significativamente la oportunidad de los padres de participar en el proceso de tomar
decisiones con respecto a la provisión de una educación pública, apropiada, y gratis al niño(a); o
si causaron una privación de beneficios educativos. Un Oficial de la Audiencia aún puede
mandar que una LEA cumpla con requisitos de procedimiento aunque el Oficial de la Audiencia
determine que el niño(a) recibió una educación pública, apropiada, y gratis. Los padres aún
pueden presentar una Queja con la Oficina de Educación Especial (en inglés, Bureau of Special
Education) con respecto a violaciones de procedimiento.
Acción Civil: Los padres o la LEA que no están de acuerdo con las conclusiones o la decisión
del Oficial de la Audiencia tienen el derecho de presentar una apelación en un tribunal estatal o
federal. A veces, los temas en un caso del proceso legal debido tratan de no sólo temas de
educación especial, sino también del estatus y/o alegación del niño(a) como dotado (en inglés,
“gifted”). En esa situación, la orden final del Oficial de la Audiencia—en la medida que trate
sobre los temas de ser dotado—solamente puede ser apelada al Tribunal Estatal (en inglés,
“Commonwealth Court”). Para todas las otras apelaciones, se recomienda a la parte que
presenta la apelación que busque un asesor legal para determinar el tribunal apropiado en donde
presentar una apelación. Una parte tiene noventa (90) días de la fecha de la decisión del Oficial
de la Audiencia para presentar una apelación al tribunal federal. Aunque este período de tiempo
para apelar la decisión al Tribunal del Estado de Pennsylvania es probablemente igual, ya que
no es claro si se aplican las reglas estatales que tratan de establecer un período uniforme de
treinta (30) días para presentar apelaciones al Tribunal, una parte que apela a dicho Tribunal
puede querer hacerlo en menos tiempo.
Honorarios del Abogado: Un tribunal, a su discreción, puede adjudicar honorarios razonables del
abogado como parte del costo: a una parte cuyas pretensiones sean estimadas la cual son los
padres de un niño con un impedimento; a una parte cuyas pretensiones sean estimadas la cual
es una Agencia Estatal Educativa o LEA, contra el abogado de los padres que ha presentado un
Aviso de Queja del Proceso Legal Debido que es frívolo, irrazonable, o sin fundamento, o contra
el abogado de los padres que continuó litigando después de que la litigación claramente se tornó
frívola, irrazonable, o sin fundamento; o a una Agencia Estatal Educativa o LEA cuyas
pretensiones sean estimadas, contra el abogado de los padres, o contra los padres, si el Aviso
de Queja del Proceso Legal Debido de los padres, o el derecho de acción subsiguiente de los
padres, fue presentado por un propósito indecoroso, como para acosar, para causar una demora
innecesaria, o para aumentar innecesariamente el costo de litigación. Los honorarios
adjudicados serán basados en las tarifas predominantes en la comunidad en la cual la acción o
procedimiento surgió, para el tipo y la cantidad de servicios proporcionados por el abogado.
La ley federal impone ciertos requisitos sobre los padres y la LEA, y en algunas circunstancias
puede que limiten indemnizaciones de honorarios del abogado. Es recomendable que los
padres consulten con su asesor legal con respecto a estos temas. Las reglas siguientes aplican:
Los honorarios del abogado no pueden ser adjudicados y los costos relacionados no pueden ser
reembolsados en alguna acción o procedimiento para servicios rendidos con posterioridad al
tiempo de una oferta escrita de un acuerdo a los padres si la oferta es hecha dentro del tiempo
señalado por la Regla 68 de las Reglas Federales de Procedimientos Civiles, o, en el caso de
una audiencia administrativa, en alguna instancia más de diez (10) días antes que el
procedimiento empiece; la oferta no es aceptada dentro de diez (10) días; y el tribunal declara
que la indemnización obtenida al final por los padres no es más favorable a los padres que la
oferta para un convenio. Una indemnización de honorarios del abogado y costos relacionados
pueden ser hechos a los padres cuyas pretensiones fueron estimadas y que tuvieron una

no pueden ser adjudicados con relación a alguna reunión del equipo del Programa de Educación
Individualizado (IEP, por sus siglas en inglés) a menos que la reunión ocurra como un resultado
de un procedimiento administrativo o acción judicial. Una sesión de resolución del proceso legal
debido no es considerada una reunión programada como el resultado de una audiencia
administrativa o una acción judicial, ni una audiencia administrativa o acción judicial para
reembolsar honorarios del abogado. El Tribunal puede reducir la cantidad de cualquiera
indemnización de honorarios del abogado cuando:
Los padres, o su abogado, durante el curso de la acción o procedimiento, prolongó sin razón la
resolución final de la controversia; la cantidad de los honorarios del abogado de cualquier otra
manera autorizados a ser adjudicados excede sin razón la tarifa salarial dominante en la
comunidad para servicios semejantes ofrecidos por abogados que posean una destreza,
reputación, y experiencia razonablemente comparable; el tiempo pasado y servicios legales
proporcionados son excesivos considerando la naturaleza de la acción o procedimiento; o el
abogado que representa los padres no proveyó a la agencia local educativa la información
apropiada en el Aviso de Queja del Proceso Legal Debido. Estas reducciones no se aplican en
ninguna acción o procedimiento si el tribunal declara que el Estado o LEA prolongó
razonablemente la resolución final de la acción o procedimiento.
Estado del Niño durante Procedimientos Administrativos: Cuando un oficial de la audiencia
acuerda con los padres del niño de que un cambio de la colocación es apropiado, el niño recibe
dicha colocación aún si la LEA apela la decisión. Vea 34 CFR §518(d). Dentro de treinta (30)
días de la decisión del oficial de la audiencia, un formulario de garantía debe ser completado por
el Superintendente o el Director Ejecutivo, y devuelto al Gerente del Caso asignado de la Oficina
para la Resolución de Disputas, asegurando que el niño ha recibido la colocación ordenada sin
