A moving target
Watchdog’s stance on hedge funds needs to evolve
Hedge funds do not stand still. That is one of the few certainties in the uncertain world of hedge fund regulation. As Britain’s Financial Services Authority acknowledged this week in two thoughtful discussion on the issue, the very definition of a hedge fund is in flux. The FSA’s paper on the protection for retail investors does not even risk using this term in its title. “‘Wider range’ investment products” is its preferred description of those products that “exhibit high degrees of volatility, illiquidity and which appear in a variety of different forms and structures”.

Os fundos hedge não ficam parados. Essa é uma das poucas certezas no mundo incerto da regulamentação dos fundos hedge. A Autoridade de Serviços Financeiros (FSA) da Grã-Bretanha admitiu esta semana em dois reflexivos artigos de discussão sobre o assunto, que a definição exata de um fundo hedge reside no fluxo. O artigo da FSA sobre a proteção para investidores de varejo nem mesmo arrisca-se a utilizar o termo em seu título. “Produtos de investmento de ‘maior alcance’” é a descrição preferida daqueles produtos que “exibem altos graus de volatilidade, iliqüidez ou complexidade e que aparecem em uma variedade de diferentes formatos e estruturas”.
