O crime de resultado cortado é também conhecido como delito de intenção transcendental. É o que exige do agente uma finalidade além daquela prevista no tipo para a consumação da conduta delituosa. Trata-se de crime formal ou de consumação antecipada.

É o contexto ilícito no qual existe uma finalidade do agente que transcende o dolo, intenção além do dolo. O agente busca realizar o dolo e depois atingir um diverso resultado. Se o agente alcança sua pretensão ulterior, isso caracteriza mero exaurimento do crime.


Exemplo de delito de resultado cortado é a extorsão mediante sequestro, vejamos:

Artigo 159 do Código Penal: “Sequestrar pessoa com o fim de obter, para si ou para outrem, qualquer vantagem, como condição ou preço do resgate.”

A vantagem recebida pelo autor é apenas exaurimento do crime, não sendo necessária para a consumação da figura típica. Portanto, crime de resultado cortado é compreendido como aquele em que o agente visa a realizar um resultado posterior, porém, dispensável para a consumação do delito.
