6. Princípios Jurídicos na Colonização do Novo Mundo: O debate sobre a escravidão indígena nas Américas portuguesa e espanhola

Durante a colonização do Novo Mundo, a escravidão foi instituída em moldes e numa proporção jamais experimentada. Se por um lado o cativeiro do africano não incomodou a consciência europeia, por outro, a escravização dos índios gerou intenso debate. A proposta desse artigo é de apresentar os motivos pelos quais negros e índios foram juridicamente diferenciados ao serem submetidos à ordem colonial. No caso dos índios, analisamos as razões da polêmica gerada em torno de sua liberdade e cativeiro.
