In E&W, where bankrupotcy is personal and insolvency is either personal or corporate, it might be a petition for an insolvency order against the Co's subsid. or, likelier, a *petition for a winding-up order on the ground of insolvency* vs. because it is 'just and equitable. The lingo of insolvency/ bankruptcy/ (Scotland) sequestration varies from Canada via Ireland, North and South, to Oz and New Zealand. recuperação judicial possibly connotes a reorganizational Chapter 11 in the US and, in E&W: a CVA = company voluntary administration or 'Examinership vs. Receivership' in the Rep. of Eire. Porém, não faz sentido a empresa ter de requerer a inclusão de uma sucursal, a menos que seja outra empresa, com outro nome, que não faça parte do grupo que está entrando em concordata, e que precise ser solicitado separadamente. Acho melhor obter a opinião de alguém da área de Direito, pois não sou especialista nisto. |
