Partindo-se da premissa segundo a qual a tributação é uma função política, e que recebe influxos econômicos, sociais, ambientais, ou mesmo culturais, tudo a partir de uma diretriz política, identifca-se na Extrafiscalidade um modus operandi presente e permanente no sistema constitucional (político) tributário, a merecer inclusive a devida localidade terminológica (extra= para além). Defende-se que toda tributação tem o devido cunho político decisório, ao que desconsideramos, por isso, a existência de uma categoria de tributos puramente fiscais, já que finança neutra pode significar: política com forte cunho conservador e liberal. A partir destas premissas, o presente artigo objetiva relacionar a extrafiscalidade com o princípio da capacidade contributiva, combatendo, assim, as teses consagradas de que uma política extrafiscal põe de lado a consideração da capacidade contributiva em prol de um objetivo público de Estado. Entendendo ser a capacidade contributiva o princípio-síntese do sistema constitucional fiscal, não há que se constrangê-la em prol do que já é também evidente em termos de processos políticos decisórios. Extrafiscalidade e capacidade contributiva se complementam.

Esse "não há que..." significa "não há razão por que...".
Creio que o "constrangê-la" tem o sentido de "inibi-la, impedi-la", isto é, "não a considerar, desconsiderá-la, descartá-la" no âmbito da extrafiscalidade.
Então, a frase toda "não há que se constrangê-la em prol do que já é também evidente em termos de processos políticos decisórios" pode ser traduzida para algo como: "there is no reason why one should disregard/dismiss/ignore it in favor of what is already evident also in terms of political decision-making processes."

Já traduzi um TCC sobre Direito Tributário, por isso, minha sugestão seria algo como :

"Once taxpaying ability can be understood as the principle and synthesis of the constitutional-based fiscal system, there is no reason why one should constrict it (or circumscribe it) in favor of what is already evident in terms of political decision-making processes."

Acredito que "constrict" ou "circumscribe" seriam termos adequados, pois no contexto, depois, lê-se:
Extrafiscalidade e capacidade contributiva se complementam.
Além disso, há toda a explicação sobre extrafiscalidade e capacidade contributiva nos primeiros parágrafos.
